1. Agreement to Terms

By accessing or using Mariscal.ai ("the Service"), operated by Frontier Digital Creations LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Mariscal.ai is an AI-powered SaaS platform that generates professional websites for local businesses through conversational interaction. The Service uses artificial intelligence to create website content, design, and structure based on information provided by the user.

3. Account Registration

To use the Service, you must create an account providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

4. Subscription & Pricing

The Service is offered on a monthly subscription basis at €27.50/month. New subscribers receive a 14-day free trial. During the trial period, no payment method is required. If you do not add a valid payment method before the trial ends, your subscription will be automatically canceled.

Subscription fees are billed monthly in advance. You may cancel your subscription at any time through the customer portal. Cancellation takes effect at the end of the current billing period.

5. Payment Processing

All payments are processed securely through Stripe, Inc. By subscribing, you agree to Stripe's Terms of Service. We do not store your credit card information on our servers.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Generate content that is defamatory, obscene, or infringes third-party rights
• Attempt to reverse engineer, decompile, or disassemble the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use automated tools to scrape or extract data from the Service
• Resell or redistribute the Service without our written consent

7. Intellectual Property

Your Content: You retain ownership of the business information you provide. You are granted a license to use the websites generated by the Service for your business purposes.

Our Platform: The Service, including its AI models, algorithms, software, design templates, and documentation, is owned by Frontier Digital Creations LLC and protected by intellectual property laws. Nothing in these Terms grants you rights to our proprietary technology.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, Frontier Digital Creations LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly. Our total liability shall not exceed the amount paid by you in the twelve (12) months preceding the event giving rise to the claim.

10. Termination

We may suspend or terminate your account at any time if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

11. Modifications

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law

These Terms are governed by the laws of the State of Florida, United States of America, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Miami-Dade County, Florida.
